About these terms

These terms create a legal agreement between you and Donkeysoft Inc. (referred to as 'Donkeysoft', 'us', 'we'), a company registered in Canada, address 908-275 Slater Street, Ottawa, ON K1P 5H9.

By using or otherwise accessing any of our games or websites ('Services'), you agree to these Terms of Service (TOS). If you do not agree to these TOS, you may not use or otherwise access the Services.  Use of the Service is also governed by Donkeysoft's Privacy Policy, which is incorporated by reference.

You agree that you are at least 13 years of age and that if you are between 13-18 years old, your legal guardian or a holder of parental responsibility has reviewed and agrees to these terms.

Donkeysoft may issue new and additional policies related to our Services. Your right to use our Services is subject to the most up to date version of this document.

If you access the Service from a social networking site, including but not limited to Facebook, you agree to comply with its terms of service as well as these TOS.  Please see each respective Terms of Service for more information.

A. Right to use the Services

By playing games created by Donkeysoft you are using a non-exclusive, non-transferable, limited license to use the Services for personal and non-commercial use. This right is subject to your compliance with these TOS.

 

Game rules and scoring for each game can be found on this website. These rules form part of these TOS and you agree that you will comply with them in respect of each individual Game which you choose to access and/or play.

There may be times when our Services or a part of them are not available for technical or maintenance reasons.

 

Donkeysoft reserves the right to stop offering and/or supporting the Services or a part thereof at any time, at which point your license to use the Services or a part thereof will be automatically terminated.

B. Purchases

Our games may include virtual goods such as gems, bombs and shuffles.  Virtual Items are licensed to you on personal, limited, non-transferable and revocable basis and limited only for non-commercial use.  Donkeysoft may manage, modify or eliminate virtual items at any time.

C. Code of conduct

You are solely responsible for your conduct while accessing/using our Services, and you will not, under any circumstances:

Use, either directly or indirectly, automation software, hacks or any unauthorized third-party software designed to modify or interfere with the Services.

​

Use our Services in a manner that could interfere with, disrupt, spam, negatively affect other users from enjoying our Services or that could damage, disable or impair the functioning of our Services.

​

Engage in any abusive, threatening, intimidating, violent, defamatory, libelous conduct.

​

Attempt to harass and abuse another person including Donkeysoft employees.

​

Violate any intellectual property, applicable law, contract or regulation.

​

Attempt to decompile, reverse engineer or hack any of the Services, or to defeat any of the security measures or data transmitted, processed or stored by Donkeysoft.

D. Advertising/Third Party Services

By using our Services, you may be offered targeted and/or non-targeted advertising content. As such, you warrant that you agree with our Privacy Policy in relation to advertising. Please read all third party terms and conditions carefully as they service as an agreement between you and the third party service provider. 

 

Donkeysoft is not responsible for the third-party products or services displayed therein.  For more information, please refer to our Privacy Policy.

E. Limitations of Liability

You acknowledge that Donkeysoft Inc. is not liable for any incidental or consequential damages resulting from access, use or malfunction of the Services, including but not limited to, damages to property, loss of goodwill, data, device failure or malfunction and, to the extent permitted by law, damages for personal injuries, property damage or punitive damages from any causes of action arising out of or related to these TOS or the Services, whether arising in tort (including negligence), contract, strict liability or otherwise and whether or not Donkeysoft has been advised of the possibility of such damages.
